§ 1 Scope of application

For the business relationship between Clean Beauty GmbH – hereinafter referred to as “jung skin” – and the customer, the following General Terms and Conditions apply exclusively in the version valid at the time of the order. Deviating terms and conditions of business or purchase of the customer shall only be recognized if they have been expressly agreed in writing.

§ 2 Conclusion of contract

Sending an order via the website constitutes a binding offer by the customer to jung skin to conclude a purchase contract. When you place an order with jung skin, we will send you an e-mail confirming receipt of your order and listing its details (order confirmation). This order confirmation does not constitute acceptance of your offer, but is only intended to inform you that we have received your order. A purchase contract is only concluded when we dispatch the ordered product to you and confirm the dispatch to you with a second e-mail (dispatch confirmation). No purchase contract is concluded for products from the same order that are not listed in the shipping confirmation.

Jung skin does not offer products for purchase by minors. Products for children can also only be purchased by adults. Your order also includes the assurance that you are of legal age. We do not accept any liability for products ordered by minors.

§ 3 Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. To exercise your right of withdrawal, you must inform us by e-mail: kundenservice@jungskin.com of your decision to withdraw from this contract by means of a clear statement. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. However, we may refuse to make the repayment until we have received the goods back.

To make it easier for us to process your return, please enclose a note with your order number, name and e-mail address and, if possible, state the reason for returning the item(s). Items that are expressly excluded from exchange cannot be returned. Send the goods immediately and in any case within fourteen days at the latest from the day on which you informed us of the revocation of this contract to

The deadline is met if you send the goods before the fourteen-day period has expired. Please note that you are responsible for the costs of returning the goods, unless it is a fault or defect caused by us. We recommend that you send your parcel with tracking. Otherwise we will not be able to trace any lost parcels and therefore cannot be held liable for them. In the event of an error on our part, you should inform us in advance so that we can send you a return label. You only have to pay for any loss in value of the goods if this loss in value is due to handling by you that is not necessary for checking the condition, properties and functionality of the goods or if you have used the goods beyond testing them.

We will contact you as soon as we have received the package and have arranged for your refund.

§ 4 Return costs agreement

The costs of the return shipment shall be borne by you in the event of a revocation.

§ 5 Delivery

Unless otherwise agreed, delivery will be made to the delivery address specified by the customer. On the website you will find information on the availability of products sold directly by jung skin (e.g. on the respective product detail page).

If delivery to the customer is not possible because the delivered goods do not fit through the customer’s front door, front door or staircase exit or because the customer is not found at the delivery address provided by him, although the delivery time was announced to the customer with a reasonable period of notice, the customer shall bear the costs for the unsuccessful delivery. Shipping costs are incurred for the shipment of the ordered goods, unless otherwise specified. Within Germany, Austria and Switzerland, the shipping costs for CO2-neutral shipping are €/CHF 5.

§ 6 Due date and payment, default

You can pay the purchase price by SEPA bank transfer, Klarna Sofort, Klarna Pay Now, Klarna invoice, Klarna installment purchase, Visa, Mastercard and Paypal. Jung skin reserves the right not to offer certain payment methods in individual cases. If you are in default of payment, jung skin is entitled to charge interest on arrears at a rate of 5% above the prime rate announced by the European Central Bank. If jung skin can prove that it has incurred higher damage caused by default, jung skin is entitled to claim this.

§ 7 Offsetting, retention

The customer is only entitled to offset if his counterclaims have been legally established or are undisputed by jung skin. In addition, he is authorized to exercise a right of retention insofar as his counterclaim is based on the same contractual relationship.

§ 8 Price

Unless expressly stated otherwise, the prices quoted by jung skin include statutory VAT.

§ 9 Retention of title

The delivered goods remain the property of jung skin until full payment has been made.

§ 10 Liability for defects

The right to cancel your order does not affect your rights as a buyer under the statutory warranty provisions. If goods purchased from us are defective, your claims as a buyer shall expire within 2 years of delivery of the goods. In the event of defects in the purchased item, the statutory claims for subsequent performance, removal/redelivery and – if the special legal requirements are met – the further claims for reduction or withdrawal, as well as compensation for damages, including compensation for damages instead of performance and compensation for your futile expenses, shall apply at your discretion. Please keep the invoice carefully as proof of purchase. If the supplementary performance has taken the form of a replacement delivery, you are obliged to return the goods first delivered to jung skin within 30 days at jung skin’s expense. The return of the defective goods must be made in accordance with the statutory provisions. Jung skin reserves the right to claim damages under the statutory conditions. Jung skin is liable without limitation insofar as the cause of the damage is based on intent or gross negligence.

Furthermore, jung skin is liable for the slightly negligent breach of essential obligations, the breach of which endangers the achievement of the purpose of the contract, or for the breach of obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which you regularly rely. In this case, however, jung skin is only liable for the foreseeable damage typical of the contract. Jung skin is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.

The above limitations of liability shall not apply in the event of injury to life, limb or health, for a defect following the assumption of a guarantee for the quality of the product and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.

Insofar as jung skin’s liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.

§ 11 Discount codes, offers and promotions

We occasionally send out discount codes as part of promotional campaigns, for example by e-mail. Each discount code is unique, limited to one recipient and non-transferable. It is not possible to refund or pay out a code. The period of validity of the discount codes may be limited and will be communicated accordingly at the time of the promotion; an extension is excluded.

If a discount code has expired or is otherwise invalid, no replacement codes will be issued. Only one discount code can be redeemed per order.

If a discount code is used for orders with multiple items, the discount will be applied to the respective individual product price. In the case of returns, only the reduced purchase price will be refunded. There is no entitlement to a refund of the discount.

We reserve the right to exclude products and product categories from discounts and promotions. Currently, there are also products that are excluded from all discounts, offers and promotions.

§ 12 Applicable law

German law applies to deliveries within Germany. Austrian law applies to deliveries within Austria. Swiss law applies to deliveries within Switzerland.

§ 13 Subscription delivery

By placing this order, we are authorized to charge your card for future orders at the delivery frequency and quantity of your choice. The cost of each shipment may vary depending on the quantity and frequency of the order. Subscription deliveries will be sent automatically unless you cancel your order beforehand. All items purchased as subscription deliveries are excluded from discounts, offers and promotions.

To cancel the subscription delivery, please visit the “Subscription delivery” section of your user account and click on the link to cancel the subscription deliveries. You will be asked to confirm this action and state why you have decided to cancel the subscription deliveries. Your automatic subscription deliveries will be canceled and no further orders will be placed. You will receive an e-mail confirmation of the cancellation.
